Adding partner to contract

 
Hi there! Just had a quick flick through this website and I must say I'm really impressed with the knowledge held in all of your heads!

I am the only tenant named on the current assured shorthold tenancy, and i want my partner to move in with me, and apparantly i've got to get him referenced by the letting agency managing the property for the landlord (not free) and then get a new contract drawn up (also not free). so, i think what i'm asking is... do i have to? is it a legal obligation that i have to declare all occupants above the age of 18 or is it my business who I want legally responsible for anything that happens, i.e. rent arrears, etc. I've been a good tenant and I'm keeping the property in a really good condition. It just scalds a bit when it's gonna cost over £150 for my partner to move in!!

Why do you need your partner on the tenancy agreement? She/he has the right to occupy your property as your guest for as long as you rent the property, you should not have to notify your landlord of this as it is unreasonable to be expected to obtain (expensive) permission for a friend to saty overnight! What your landlord/agent is demanding is the costs or re-issuing the AST with you and your partner's name as joint tenants and to do this it is reasonable to do a credit/reference check on your partner. There is however absolutely no need for your partner to be on the tenancy agreement. You pay the rent and as you both agree, she/he helps you with the costs of living in some way. In the worst case, if you fail to pay your rent, and your landlord takes court action to evict you, the bailiff will require your partner to leave when you are required to, thus yur landlord is still totally protected against theat (probably unthinkable) possibility.
