Ending an Assured Shorthold Tenacy 

Hello,
I want to give the landlord one months notice in order to end an Assurred Shorthold Tenacy after the initial six month agreement has passed. The tenancy was extended by way of a letter from the landlord. The landlord is now saying that one months notice must be served from the date the rent is due. While the tenancy agreement notes that this is the case during the original six month agreement it does not state it applies to any extension of the agreement. The tenancy agreement also notes that an extension must be done by way of a Memorandum of Agreement but its does not appear that this has happened (it was only extended by way of the letter noted above). What are my rights in this situation? Any suggestions would be helpful!

The letter from your landlord was unnnecessary as was the "memorandum" specified in the original agreement. As soon as your AST expired, it was automatically replaced in law by a statutory periodic tenancy and this has the same terms as the tenancy agreement it replaced. If no other terms are written into the original agreement, then the tenant can terminate same by giving a month's notice and the landlord has to give two. However there are notice terms in your original lease and so your notice should be served in accordance with these.
