I am a homeowner living in a ground floor flat. The problem is the tenant upstairs who constantly makes my life a misery.She is noisy, has behavioural problems, plays loud music, and doesn't work so she is at home all day. She litters the communal hallway with her possessions and refuses to listen to any advice or warnings about her behaviour.
I have spoken to her landlord who is reluctant to evict her because a) she has made threats to his safety b) he has guaranteed rent from her via her benefits c) he has just renewed her 12 month lease. Last year she promised to move out, took receipt of her deposit and then chose to stay. She did not return the deposit claiming she 'had spent it'.
I know this site gives indication of the landlord' rights and tenants' rights but WHAT ABOUT MY RIGHTS as a neighbour who 'has the right to a peaceful existence without undue disturbance'.
This neighbour of mine has caused me an enormous amount of stress and we often come to blows, mostly verbal but recently physical too.
Do I have rights and can I influence anyone's decision to have her removed?
