Neighbour Nuisance - Westminster CC 

I bought my property from Westminster Council some yrs back. For the past 3 yrs. I have had problems with a neighbour (council tenant) who continues to make noise and throw rubbish onto my balcony. I have complained to the Council who have not taken this seriously. In the next 2 weeks I have to meet with the Housing Officer & Complaints Manager for a Stage 3 complaint meeting.

I don't know if this process is just an exercise and will not deal/solve the problems.

My queries are this:

1. What is the council's legal duty to me? My property is in a council block but I still pay council service charges.

2. Should I sue the Council & if so for what? Breach of their contract with me??

3. What about the recording of evidence - photographic/sound - what are the legalities of this?

4. I was told I could bring my neighbour to court but should it not be the council's responsibility since they are the neighbour's landlords and have continued to ignore the problem.

Any advice in the right direction would be much appreciated.

I don't think the council can be sued for this, unless you can categorically prove that their negligence has caused damage to your life or wellbeing. I would investigate maybe trying to make the neighbours the subject of an anti social behaviour order, which would force them to keep the noise down. Technically - whether they followed the order or not is another question.

I would give the Stage 3 complaint meeting a good go and then take things from there.
