Subsidence 

Hope you can give me some advice. We have been in our present house for 2 years end of
october 02. We had our kitchen retiled, plastered etc a few months ago. Since then we
have noticed a large crack appearing in the
wall and all around the window sill cracking all the new tiles. We have had our incurance
people down and they have told us that we have subsidence. When we bought our house I
specifically asked the present owner if the
kitchen was an extension. He said it wasn't.
Since then we have been told by various builders that it is an extention. This wasn't mentioned in the house details, and the surveyor didn't pick this up.
Please can you advise if anyone along the line can be held responsible for this as we now have an excess charge of GBP1000 to pay and also chances of our property being devalued.

If the surveyor was negligent in his failure to spot the problem, then there could be a case to answer. It also depends on what sort of survey you had. If it was just a basic valuation, then you probably can't point the finger anywhere other than at yourself, but if it was a full survey, I would guess that the surveyor should have picked it up.
