guarantor 

my partner signed and agreement to be guarantor for my daughter. As she is on a low income the council paid part of her rent. Due to some clerical error the council stopped paying her rent. As a result she owes 2 months rent. Her lease was for six months and that rent was all paid up but she has been told by the council that she can stay in the flaat for an extra 2 months. The letting agency have just phoned my partner to tell him that they are taking him and my daughter to court for the 2 months rent. We thought that he was no longer responsible after the six months. can anyone tell me if this is right.

Depends on the wording of the 'Guarantee of Tenancy Agreement'.

unfortuantely it seems you have got on the wrong side of a bad agent.

What it appears they have done is told you it is a 6 month contract. When actually it is not. That is against the law. However proving it is difficult.

They got you to sign a 12 month contract with a 6 month break and 2 months notice. If he has contracts signed by your daughter and yourselves you are in a pickle.

Under british law contracts are recurring on a monthly basis until cancelled unless otherwise specified in the contract. Therefore if you didnt give your 2 months notice until after the 6 month period the agent is right.

Technically you owe the money unless you can prove you were mis sold.

I would seek legal advice.
