landlord wants to cut out agent 

my landlord has come to us to ask if we will pay him direct and cut out agent, we have lived in this property nearly 4 years, and have had lillte trouble, my worrie is that what happens if something needs repairing, will my landlord be as quick as our agent has been to get these things done? what is your advice? also there is no inventory on this property, so can he hold back any deposit when we leave? we have done alot of decorating to improve the house.

Hi Shan

Firstly, the thing that should concern you is to whom holds your deposit? We note that you have been there for 4 years, if the contract was renewed after April last year. Your deposit needs to be put into an approved accredation scheme. As all deposits are covered by these, par rooms that are let in landlord resident houses.

If you landlord is adamant that he wants to do this, you should request a new inventory, noting the conditon as of the change over. He may just want to side step the agent, if you have been good tenants and feels it may be finanically benefical to deal with you direct. A full written and photographic inventory should be drawn with you both going through this on the day of change over. Thus, you both would be aware of the condition at this point. It may also prove prudent for him to confirm that he was agreeble to all the decorating that has taken place (hopefully with his consent via the agent).

The agents usually acts as a buffer between the 2 concerning parties, and i have found as a landlord having someone else to shout at keeps the tenant landlord relationship sweet.

But it is your call. Sometimes it may be beneficial to deal direct with the landlord, may speed things up and keep things clear.

I wouldn't worry unduly. Pebble's advice is sound and this should be discussed with your landlord. Remember that the agent is the landlord's agent and if he wants to replace him or eliminate him altogether then this is the landlord's right. If you are worried about repairs then don't forget that if the landlord fails to carry these out then you can give him an ultimatum to do them, submitting quotations and if they remain uncompleted within a reasonable time frame carry out the repairs yourself, deducting the cost from rental payments.
