landords responsibility 

My ex-landlord did not return any deposit and failed to do a repair, which has left us with a £500 water bill. After several phonecalls which achieved nothing, we wrote to him and told him that we would take him to the small claims court. We then recieved a letter with a minimal amount of deposit back and a list of charges. The letter stated that we must have left the taps on and it was nothing to do with him, and he listed charges included things which were wrong when we moved in e.g missing curtain rail, and for work he had to do on the garden - he provided us with no means of doing any work in the garden and no-where in the contract does it say we had to provide our own tools. I have been to the CAB and they think we still have a good case as he has broken many terms of the contract and failed in obligations, so i am presently writing to him to inform him that we are going to continue with the case. However, in his letter he states that it was our responsibilty to tell him if anything needed to be done to the property within the first week - but itsn't it up to him to have checked the state of the house as left by the previous tenants and complete an invetory before we moved in? Surely it is not our job as new tenants to completely do this for him?

It is indeed a tenant's responsibility to report any defect in the property to the landlord as soon as possible. I assume that you reported the defect which caused the water leak and subsequent high water bill as soon as it occurred. Did you attempt to mitigate this water loss by turning your water supply off at the main, or was this impossible or was the leak between the water meter and the main? If this was the case then I feel that you will have an excellent case of winning in the small claims court

we told him- and the water company are sending us a copy of the letter they sent us originally stating that they had investigated and found it to be a problem with the hjouse not the supply as they had originally thought and therefore definatly his responsibilty. i don't even know where the water main was and that would have left us with no way to wash or cook - and with 4 people leading separate l;ives thats impossible. with the 'defects' i am talking about, its not stuff we really saw as a huge problem-eg missing curtains - when we first moved in because we didnt know they were meant to be there (- if you see what i mean), but he is now charging us for them - meaning he didnt check the property in the interveneing time to check on the last tenants - who i am therefore assuming got none of their deposit back either but didnt make such a fuss!

Make sure that you have all your documentation in order and look forward to your small claims court appearance!
