can the owner of the freehold take money out of the surplus fund to pay for non payment of service charge byother leaseholders ?

I shouldn't have thought so, unless there is a clause to that effect in the lease. The surplus should be for major items of maintenance and emergencies. It would be normal for the freeholder to pursue the individual leaseholder with legal action in the event of non-payment.
