Terms of use for the private vendors service
In all following paragraphs, the terms "you" and
"your" refers to customer purchasing a listings
advert for a property on TheMoveChannel.com "We"
/"us" /"ours" refers to On The Move Ltd
trading as TheMoveChannel.com.
Property misdescriptions
By purchasing a listing for a private sale property on this
site, you warrant that:
- That you are the legal owner of the property with the
sole right to sell, or you have either legal power of attorney
on behalf of the property owner or the full consent of any
co-owners.
- That all details supplied by you for publishing on TheMoveChannel.com
are, to the best of your knowledge, fair, honest, accurate
and not misleading in any material way.
- The accuracy of the information you supply is your responsibility
and you agree to indemnify TheMoveChannel.com against any
legal claims or other expenses that arise as a result of
misleading or inaccurate claims you make about the property
you are advertising.
- We reserve the right to edit or delete any descriptions
which we believe to be inaccurate, misleading or fanciful.
- Property descriptions should only include factual descriptions
that are a matter of fact and which can be verified by reasonable
inspection, or in the case of any legal aspects, confirmed
by available documentation.
- Where there is a dispute, the decision of TheMoveChannel.com
is final.
Pricing
We reserve the right to amend or change package prices at
any time without notice. Price alterations will only apply
to new listings, not those already on the website. All prices
are quoted including any payable VAT.
Cancellation and refunds
You may cancel your listings purchase for any reason within
2 working days (Monday to Friday inclusive) of it being confirmed
by admin and thereafter being added to the site database.
Following a cancellation request, we will initiate a full
refund of all money within 2 business days.
No refund will be made after publication of paid advertising
following the 2 working day cancellation period, subject to
the discretion of the directors.
This does not affect your statutory rights as a consumer
Limitation of liability
Neither we nor any of our sister, parent or subsidiary companies
will be liable to you, whether for negligence, breach of contract,
misrepresentation or otherwise, for any direct, indirect or
consequential damage (including without limitation, loss of
profit, goodwill, business opportunity or anticipated savings),
suffered by you as a result of your use of the site, or any
linked through to from it, or any information, materials,
software or services provided on or through it or downloaded
from it, or your inability to use the site, any error in the
provision of this site or any computer virus transmitted through
this site.
No Warranty
We (and our parent, subsidiaries, affiliates, officers,
directors, agents and employees) do not guarantee continuous,
uninterrupted or secure access to our services, and operation
of the Site may be interfered with by numerous factors outside
of our control. Our website and our services are provided
"as is" and as and when available, and to the extent
permissible by law we exclude all implied warranties, conditions
or other terms, whether implied by statute or otherwise, including
without limitation any terms as to skill and care or timeliness
of performance. Some jurisdictions do not allow the disclaimer
of implied warranties, so the foregoing disclaimer may not
apply to you.
Third Party Rights.
A person who is not a party to this User Agreement has no
right under the Contracts (Rights of Third Parties) Act 1999
to enforce any term of this User Agreement but this does not
affect any right or remedy of a third party specified in this
User Agreement or which exists or is available apart from
that Act.
Copyright
Unless otherwise indicated, the copyright for the material
contained in the TheMoveChannel.com web site belongs exclusively
to On The Move Ltd. You may view this site and you are welcome
to print hard copies of material on it for your personal,
non-commercial use. All other copying whether in electronic,
hard copy or other format is prohibited and all other rights
in respect of copying, broadcasting or onward publication
are reserved.
If you are providing us with photographs for publication
with your property details, you acknowledge that you are the
copyright owner of such material or that you have full consent
from the copyright owner to freely distribute those photographs
for onward publication. You hereby agree to indemnify TheMoveChannel.com
against all claims made in respect of breach of copyright
issues arising as a result of providing us with material for
onward publication for which you do not own the copyright.
Jurisdiction
These Terms and Conditions and any matter relating to this
site shall be governed by English law and the English courts
shall have non-exclusive jurisdiction in respect of them.
Complaints
Whether you choose us as your only online listing service
or as one of a handful of top quality sites, you are well
advised to find space for us in your home-selling budget.
